RULES AND REGULATIONS OF THE CONGREGATION AGUDATH SHOLOM CEMETERY ASSOCIATION

  1. GENERAL
    1. The rules and regulations herein shall apply to all parts of the Congregation Agudath Sholom Cemetery.
    2. This Cemetery is owned and operated by the Congregation Agudath Sholom Cemetery Association (CASCA), Stamford, Connecticut. These rules and regulations may be changed only by the Board of Directors of that institution. 
    3. If a person feels he needs special consideration as regards payment of burial rights or perpetual care, he should make his request to the Congregation Agudath Sholom synagogue, as CASCA gives no special consideration.
  2. CEMETERY MANAGEMENT
    1. All burial plots shall be held and managed in pursuance with the regulations of the cemetery as they now exist or shall be amended in the future, and subject to all local, state, and federal regulations pertaining to the operation of cemeteries.
    2. The owner of plot reservations (hereinafter referred to as the "owner") acquires the exclusive right of the use of the plot for burial and interment and related purposes, but the fee ownership of the land remains in the Association. At the time of purchasing burial rights, the owner will notify CASCA as to whom he is assigning the plots. If any assignments are subsequently changed, he will so notify CASCA.
    3. No plot may be sold or transferred either for a fee or given as a gift; if any such transfer should occur, the plot will immediately revert to the Association. 
    4. No plot may be subdivided; if any such subdivision should occur, the plot will immediately revert to the Association. 
    5. Plot owners, members of their families and relatives of persons buried in the cemetery shall be allowed access to the grounds at all reasonable times on the condition of their observance of the rules and regulations of the cemetery.
    6. The plot owner shall notify the Association of any change in his address, and notice to the plot owner shall be sufficient if sent to the last address on file with the Association. Any changes in rules or regulations of CASCA shall be published in two successive issues of the Congregation Agudath Sholom Bulletin. Such publication shall be considered sufficient notice to all plot owners. 
    7. The Association reserves the right to change the layout of the cemetery, its plots, avenues and walks. It may establish grades throughout the cemetery as it may deem fit, but no person may change the grade of a plot or any portion thereof, without permission of the Association. 
    8. The Association reserves the right to use temporarily any plots to receive materials necessary for making any excavations or improvements. 
    9. The perpetual care which CASCA shall provide to all plots is limited to mowing of grass, removal of leaves and other debris caused by storms, and adding topsoil and seed if the surface of a plot becomes depressed. The Association disclaims all responsibility for damage caused to any grave, fixture, structure, or other item which is reasonably beyond its control, and the Association shall in no way be responsible for damage caused by the elements, and act of G-d, a common enemy, thieves, vandals, strikers, explosions, unavoidable accidents, riots, or order of any civil or military authority, whether the damage be direct or collateral.
    10. No interment shall be permitted or memorial placed in or on any property not fully paid for except by special consent of the Association in writing. In the event such consent shall be given, any interment or memorial in or on the property of the Association shall be considered as temporary until payment is completed, and a note shall not be considered as payment, and no rights shall be acquired by the plot purchaser until such property is fully paid for in cash. In the event of a default by the purchaser, the Association shall be released from all obligations hereunder, may retain any payments which have been made as liquidated claims, and may reenter the property to remove the deceased or such memorial. 
  3. BURIAL
    1. Plots are to be used only for burial of dead of the Jewish faith. 
    2. The methods of burial shall be prescribed by Jewish law as approved by the Association. 
    3. Airtight vaults or coffins are not to be used. 
    4. The box or boards enclosing the deceased shall be covered by a concrete liner with holes in its bottom, as approved by rabbinical authorities. 
    5. The body of any person who has died by his own hand or shall have been executed for any crime or shall have died in prison or jail after having been convicted of any crime may not be buried except in plots designated by the Association and provided for that purpose. 
    6. No graves may be opened for the purpose of burial without the consent of the Chairman of the Cemetery Committee or his designated representative. 
    7. In the event of burial in a plot not fully paid for, the plot owner or his estate will pay to the Association the remaining balance due. 
    8. Plot owners who are members of the Agudath Sholom Synagogue may use those plots for burial only of spouses and minor children. Members may use plots for the burial of adult children who are not living at home, but must then pay the increment in price set by CASCA as pertaining to nonmembers (see III. 10 below). 
    9. If an adult member in good standing at the Agudath Sholom Synagogue for a period of at least ten years buys burial rights and then cannot maintain this good standing (by virtue of extreme age or illness or having moved out of Fairfield County), that person shall nevertheless retain the burial rights bought as a member. 
    10. Years ago, CASCA policy was that a synagogue member and spouse were entitled to free plots for their own interment. Although we no longer offer such entitlements, we continue to honor this policy for the people who were members during that period. All members must, of course, pay for perpetual care for their plots. 
    11. If, in the judgment of the committee chairman, plots are in reasonable supply, nonmembers may purchase them at a price higher than that for members. 
  4. DISINTERMENT
    1. Disinterment may be made only with the written consent of the owner of the plot (or his heirs) and the Association, or upon the order of a duly constituted public official. All disinterments shall be at the discretion of the Association as to time and manner, and all expense of disinterment shall be borne by the plot owner or party causing the disinterment. 
  5. MONUMENTS, FLOWERS, SHRUBBERY, ETC.
    1. No mausoleum, vault, monument or any other structure or work may be erected or situated without the written permission of the Association. Any and all work done without said permission may be removed at the expense of the plot owner. 
    2. Footings for headstones or markers must be suitable to support such a monument. Such footings must have the prior approval of the Cemetery Committee Chairman or his designee. Should repair or corrective work be necessary, the plot owner shall be notified and should the work not be completed in a reasonable time, such work will be done at the expense of the plot owner. 
    3. The tops of headstones are to be no higher than forty-two (42) inches from the Ground in Stamford or thirty-six (36) inches in Darien. They shall be no wider than seventy-two (72) inches, and they shall have finished (smooth) backs. If a headstone is common to more than one plot, it shall be centered over the plots involved. If a family buys a set of four or more adjacent plots, it may place markers at the corners of that set of plots. If so placed, markers shall be of stone similar to the headstone and be no larger than a six-inch square. 
    4. Footstones or markers shall be flush with the ground. 
    5. No Ledgers Allowed
    6. No fences or curbings may be placed around graves. Flowers, trees, shrubbery etc. may not be planted. 
    7. The surface of graves will be planted with grass and maintained level with the surrounding ground. 
    8. All workmen employed by plot owners to erect monuments must comply with the rules and regulations of the Association and any work left in an incomplete or improper state may be corrected or improved at the plot owner's expense. 
  6. AMENDMENT AND MODIFICATION
    1. The Association, by a majority of the Board of Directors present at an official meeting, reserves the right at any time to amend, alter, or repeal any rule or regulation in whole or in part, or to adopt new rules and regulations. 
    2. With respect to special cases which may arise and in order to avoid hardship, the Association reserves the right without notice to make exceptions, suspensions or modifications in any rule or regulation and such temporary changes shall in no way affect the general application of such rule or regulation.
